Eligible Claims under M49

  • New claims may be filed against the City for land use regulations passed after January 1, 2007 which "restrict" the residential use and reduce the fair market value of the properties. Industrial, commercial and billboard claims are no longer eligible.
  • Measure 49 Claims must be filed within five years of passage of the challenged land use regulation.
  • Claimants must submit an appraisal meeting the requirements of M49 proving that the regulation reduced the fair market value of the property.

Unincorporated Multnomah Co. Claims

Unincorporated Multnohmah Co. claims for sites in Unincorporated Multnomah County will not be accepted by the City and must be submitted directly to Multnomah County.

Lot Confirmations
A lot confirmation verifies one or more lots or lots of record have legal status as a property that is eligible for development under the zoning code.
Property Line Adjustments
A property line adjustment (PLA) is the relocation of a common property line between two abutting properties. A property line adjustment does not create a new lot line.

The purpose of a zoning confirmation letter is to verify in writing the allowed uses, development standards and regulations applicable to a specific site.
