CONFIDENTIALITY OF COMPLAINANTS
Administrative Rule Adopted by Bureau Pursuant to Rule-Making
Authority
ARB-ENB-13.09
Background:
Much of the bureau's enforcement action is initiated on the basis of
confidential complaints.
Bureau Policy:
Names of complainants and information about them are to be confidential.
Procedure:
Under the Oregon Public Records Law ORS 192.410-500, we are not required to
disclose information about complainants. These records are exempt from
disclosure.
Names of complainants and information about them will not be given out to the
public.
Written information and documents, such as complaint intake forms that have
complainant names on them, can be provided with the complainant's name, address,
and phone number blanked out.
Disclosure of a complainant's name may be relevant in a court case. The court
could order disclosure in a particular instance. This is the only instance where
complainants' names will be given out.
