DEMO DELAY FOR RESIDENTIAL OCCUPANCIES
Administrative Rule Adopted by Bureau Pursuant to Rule-Making Authority
ARB-ENB-13.05

 
Procedure for issuing a demolition permit for residential structures located on land designated under the Comprehensive Plan for residential use.
 
1. Planning Bureau staff (in Permit center) to review application address, legal description, and land use zone. This procedure is only applicable for residential demo applications on land designated under the Comprehensive Plan for residential use.
 
2. Bureau of Buildings plans examiner to:
a. Verify residential use;
 
b. Take in demo application and set up computer file;
 
c. Determine property owners from Assessors' file;
 
d. Give applicant form for owner's signature acknowledging that they are aware that future development of other than residential use will require a conditional use, plan amendment or zone change (see attached form).
 
e. Provide the PAC supervisor with copy of demo application.
3. The PAC supervisor to:
a. Within 7 calendar days notify in writing PDC and the neighborhood organization in whose boundaries the demolition is proposed, a notice of the proposed demolition and a copy of the demo application (see attached forms).
 
b. Within 2 working days, notify the Building Inspections Supervisor of the pending demolition by providing a copy of the demo application.
4. The Building Inspections Supervisor to:
a. Within 7 calendar days from the date of the application, post the structure with a notice of the proposed demolition.
5. After 30 days from the date of application, the PAC supervisor to approve the demolition and so notify the applicant.
 
NOTE: This procedure shall be waived for applicants required by the City of Portland to remove the structure because of public hazard, nuisance or liability. A copy of the City Order must accompany the demo application.
