TRN-10.22 - Street Opening Bonds

STREET OPENING BONDS

I. Definition
 
The City of Portland requires anyone applying for a street opening permit or sewer connection permit in the right-of-way to have an approved street-opening bond. The bond assures that the street is repaired to the satisfaction of the City Engineer and the street will remain in good repair for two years after completion of the job. A contractor doing a job shall have their bonding agent supply us with an annual street opening bond and as long as the bond is on file it covers any work that they do in the public right-of-way; an individual property owner may apply for a cash bond.

 
II. Administrative Rule
 
Street Opening Bonds are required for all street-opening permits.
 
A street opening bond form (PDF document 20 KB) may be obtained at 1120 SW 5th Avenue, 8th floor at the reception counter or at 1900 SW 4th Avenue, 1st floor at the Permit Counter.
 
A person authorized by the bonding company to sign bonds on their behalf shall sign the bond form. The bonding company assigns to their agents a power of attorney to act on their behalf, which shall be attached to the bond after signing it.
 
The owner or an officer of the company being bonded shall also sign the bond and list his/her position with the company.
 
The completed bond shall be submitted to the City of Portland / Street Systems Management at 1120 SW 5th Avenue Suite 800, Portland, OR 97204.
 
Faxed copies of executed bonds are not accepted; the original signed form must be submitted.
 
Prior to permit issuance, the completed bond must be approved by the city attorney.
