Administrative Rule Adopted by Private for Hire Transportation Board of Review Pursuant to Rule-Making Authority
A. A motion to impose a fuel surcharge for taxis and shuttles may be made by any Board member once the price of fuel in the Portland metropolitan area has reached or exceeded $3.00 per gallon at the time of the motion. Motions for additional fuel surcharges may be made for every 70-cent increase above $3.00 per gallon.
B. The price of fuel will be determined using the week’s average AAA price as listed on its website.
C. No fuel surcharge may be for more than 10 cents per mile for taxis, but the Board may choose to impose a surcharge of less than 10 cents per mile.
D. If, for a period of 60 days, the price of fuel remains less than the price that triggered a specific fuel surcharge, the surcharge is automatically rescinded as of the date of the next regularly-scheduled Board meeting.
E. If a surcharge is in place, signage indicating the amount and duration of the authorized surcharge must be clearly visible, posted at all times in the vehicle, and placed in the same location as where the fares are posted.
F. Fuel surcharges authorized by section 16.40.070 apply only to taxis and shuttles. No other regulated for-hire transportation industry is affected thereby.
