PURPOSE
Section 1. The Council finds:
1. Representatives of the City and the Portland Police Commanding Officers Association (PPCOA) have signed a Memorandum of Agreement that modifies the terms of Article 33, Section a, of the LaborAgreement . This modification extends the amount of Executive Leave (e-leave) that may be granted by the Chief of police to members of the PPCOA bargaining unit. This Memorandum of Agreement is effective upon endorsement by City Council.
2. Members of the PPCOA bargaining unit are subject to being constructively “on call” owing to their rank and scope of responsibility. Yet, these employees do not receive any premium similar to “on call” or “pager” pay as it is known in the LaborAgreement with the Portland Police Association (PPA). The extension of the additional e-leave that may be granted by the Chief of Police for members of the PPCOA is being proposed as a means to provide equitable compensation in lieu of “on call” or “pager” pay.
3. This
Memorandum of Agreement modifies Article 33, Section a, of the
LaborAgreement . All other terms and conditions shall remain as provided in the 2006-2010
LaborAgreement . A copy of the
Memorandum of Agreement is attached as
Exhibit A .
POLICY
NOW, THEREFORE, the Council directs:
a. That the Mayor and Auditor are hereby authorized to execute a
Memorandum of Agreement to modify Article 33, Section a, of the
Labor Agreement between the City and the PPCOA in accordance with the
Memorandum of Agreement attached as
Exhibit A .
b. This ordinance is a binding City policy.
Section 2. The Council declares that an emergency exists because delay would unnecessarily delay the orderly implementation of the provisions of the labor agreement; therefore, this ordinance shall be in full force and effect from and after its passage by the Council.
